Terms of Service
Planned Home Maintenance Effective date: July 2, 2026
These Terms of Service ("Terms") are an agreement between you ("you," "Customer") and J BAR S Contracting, LLC, doing business as "Planned Home Maintenance" ("Planned," "we," "us," "our"). They govern your enrollment in and use of our quarterly home maintenance membership and related services and communications.
By enrolling, checking the box at signup, or using our service, you confirm that you have read, understood, and agree to these Terms, including the membership term, automatic renewal, billing authorization, cancellation terms, and text-messaging terms below. If you do not agree, do not enroll.
1. The Service
Planned is a quarterly home maintenance membership. We visit your home four (4) times per year — approximately once every three (3) months — and perform the same standardized seasonal maintenance checklist on each visit. Our model is intentionally simple: the same proven checklist every visit, no custom quotes, and no upsells.
What's included depends on the plan you select at enrollment. Plans and their prices are presented to you at signup and may include routine maintenance items such as HVAC filter service, dryer-vent cleaning, water-heater flush, smoke/CO detector checks, gutter and exterior checks, irrigation service, and similar seasonal tasks, along with before-and-after photo documentation of the work performed. Higher tiers may include additional services (for example, periodic window cleaning and priority scheduling) as described for your plan at signup.
What's not included. Planned performs routine maintenance only. We do not perform major repairs, replacements, or work outside the standardized checklist. If we identify an issue during a visit that falls outside routine maintenance, we will document it and let you know; any repair beyond the scope of your plan is not covered and may require a referral to a qualified specialist. We do not guarantee that maintenance will prevent all failures, and Planned is not a substitute for licensed trade work (electrical, plumbing, HVAC repair, etc.) where such work is required.
Access. You are responsible for providing safe and reasonable access to the areas needed to perform the service on the scheduled date.
2. Membership Term and Automatic Renewal
Your membership begins on your enrollment date and continues for an initial term of twelve (12) months (the "Initial Term"). By enrolling, you agree to this 12-month commitment.
After the Initial Term, your membership automatically renews and continues on a rolling basis until you cancel in accordance with Section 4. Service is delivered quarterly (four visits per year) and billed quarterly as each visit is completed, as described in Section 3.
We may offer promotional plans in which the Initial Term commitment and/or the early cancellation fee described in Section 4 is reduced or waived. Where a promotional offer specifies different terms, the terms of that offer apply to your membership.
We will not send paper renewal notices; your membership continues automatically until canceled. You may cancel future renewals at any time as described in Section 4.
3. Billing and Payment Authorization
Recurring charges. When you enroll, you authorize Planned to charge the payment method you provide (your "card on file") on a recurring quarterly basis for the price of your selected plan, plus any applicable taxes. Each quarterly charge is processed when your visit for that quarter is completed. If a visit for a given quarter has not been completed by approximately 90 days after your last service (for example, because scheduling has been delayed), the quarterly charge for that period will process automatically so your membership remains active; the corresponding visit remains available to be scheduled and completed. This authorization continues until your membership is canceled and all amounts owed are paid. Payments are processed by our third-party payment processor (Stripe); we do not store full card numbers ourselves.
Price. The price for your plan is the amount presented to you at enrollment. We may change plan pricing on renewal; if we do, we will give you advance notice by text and/or email before the new price takes effect, and your continued membership after the effective date constitutes acceptance of the new price.
Failed payments. If a charge is declined, we may retry the charge and may pause or suspend service until payment is successfully processed. You remain responsible for amounts owed for service already scheduled or performed.
4. Cancellation and Early Cancellation Fee
You may cancel your membership at any time by emailing us at Contact@planned.llc or calling (801) 970-4085. Cancellation is effective when we process your request.
Early cancellation fee. Because we incur upfront costs to onboard, schedule, and route your service, the following applies:
- If you cancel during your Initial Term (the first twelve (12) months of your membership), a one-time early cancellation fee equal to one (1) quarterly plan charge at your plan's rate will be billed to your card on file at the time of cancellation. You authorize this charge as part of these Terms.
- If you cancel after your Initial Term has ended, no early cancellation fee applies. Your cancellation takes effect at the end of the quarter you have already been charged for, and you will not be billed for the following quarter.
- Completed quarters are non-refundable. Any visit remaining in a quarter you have already been charged for may still be scheduled and completed before your cancellation takes effect.
- Promotional plans. If you enrolled under a promotional offer that waives or reduces the Initial Term commitment or the early cancellation fee, the terms of that offer control and this fee does not apply except as that offer specifies.
- Planned may, in its sole discretion, waive or reduce the early cancellation fee.
Canceling automatic renewal. To stop your membership from automatically renewing, cancel using the method above before your next quarterly renewal date. The early cancellation fee in this Section only applies if you cancel during your Initial Term.
5. Scheduling, Rescheduling, and Skipped Visits
We schedule visits by appointment and confirm them by text and/or email. If you need to reschedule, please give us reasonable advance notice and we will work to accommodate you. If our technician cannot access your home on a scheduled visit through no fault of ours, that visit may be counted as delivered, or rescheduled at our discretion.
You may request to skip or pause a service where your circumstances require it (for example, seasonal absence). Skipping or pausing does not extend your Initial Term or waive amounts owed, and is subject to our approval.
6. Text Messaging (SMS) Terms
By providing your mobile phone number and enrolling, you consent to receive text (SMS) messages from Planned Home Maintenance at the number you provide. These messages relate to your service and account, and may include: booking and appointment confirmations, appointment reminders, visit recaps and summaries, review requests, rebooking and renewal reminders, billing and payment notifications, and replies from our customer-service team.
- Message frequency varies based on your service activity and account.
- Message and data rates may apply, depending on your mobile carrier and plan.
- To opt out, reply STOP at any time. After you reply STOP, we will send a single confirmation message and then stop sending you texts (except where a message is required to complete a transaction you have requested). Note that opting out of texts may affect our ability to send you service reminders and confirmations.
- For help, reply HELP, or contact us at (801) 970-4085 or Contact@planned.llc.
- Carriers are not liable for delayed or undelivered messages.
- Your consent to receive marketing or promotional texts is not a condition of purchasing any service.
7. Privacy and Your Mobile Information
We respect your privacy. Our full Privacy Policy is available at planned.llc/privacy.
We do not sell, rent, or share your mobile phone number or your SMS consent/opt-in information with third parties or affiliates for their own marketing or promotional purposes. We share your information only with service providers (such as our messaging and payment platforms) strictly as needed to deliver our own service and messages to you, and as otherwise described in our Privacy Policy or required by law.
8. Satisfaction and Limited Warranty
We stand behind our work. If you are not satisfied with a completed visit, contact us within 7 days and we will make reasonable efforts to address the issue on the items covered by your plan. This is our sole warranty. Except as expressly stated here, the service is provided "as is," and we disclaim all other warranties to the fullest extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose.
9. Property Access, Safety, and Right to Refuse
You agree to provide a safe working environment and to disclose known hazards (for example, aggressive pets, unstable structures, or hazardous materials) in advance. Our technicians may decline to perform, or may stop, any task they reasonably judge to be unsafe, outside the plan's scope, or beyond routine maintenance, and may refer such work to a specialist. We are not responsible for pre-existing conditions or for issues arising from the age or condition of your home, systems, or equipment.
10. Disclaimers and Limitation of Liability
To the fullest extent permitted by law, Planned will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or relating to the service or these Terms. Our total liability to you for any claim arising out of or relating to the service or these Terms will not exceed the amount you paid to Planned for the service in the three (3) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Planned and its owners, employees, and contractors from claims, damages, and expenses arising out of your breach of these Terms, your misuse of the service, or conditions on your property that you failed to disclose.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Before filing any formal claim, you agree to first contact us and attempt in good faith to resolve the matter informally. Any dispute that cannot be resolved informally will be handled in the state or federal courts located in Utah, and you consent to their jurisdiction. [If you want to require arbitration instead, have an attorney add and tailor an arbitration clause here.]
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms with a new effective date and, where appropriate, notify you by text or email. Your continued membership after changes take effect constitutes acceptance of the updated Terms.
